[Alpha Biz=(Chicago) Reporter Kim Jisun] Samsung Electronics, which was on the verge of 400 billion won in damages due to a patent dispute with U.S. semiconductor company Netlist, will take a breather.

According to industry sources on the 19th, the U.S. 9th Court of Appeals overturned the original ruling that Netlist won a recent memory patent infringement case filed by Netlist against Samsung Electronics (005930) and returned the case to the first trial court for further hearing.

The appeals court quashed the violation of Samsung Electronics' supply obligations, saying, "We need to further review the contents of the contract and facts." "Samsung Electronics cannot be considered to have violated its obligation to collect the original tax," he said, scrapping the violation of the obligation.

Netlist previously filed a lawsuit with the U.S. Central District Court in California, claiming that Samsung Electronics violated joint development and patent license supply obligations and withholding tax collection obligations signed between the two companies in May 2020.

In February last year, the California Central District Court acknowledged the Netlist's claim. Samsung Electronics appealed.

Netlist has filed patent infringement lawsuits against Samsung Electronics in the U.S. and Germany, insisting on the legal termination of the license contract, which is the issue of the contract lawsuit.

In August, the Texas Eastern District Court accepted the jury's verdict on the infringement of Samsung Electronics' memory patent filed by Netlist and ruled that it should pay $303.15 million (about 400 billion won) in damages.

With this remand after reversal, the patent infringement lawsuit between Samsung Electronics and Netlist has entered a new phase. If Samsung Electronics wins the final case, it is expected to affect other patent infringement lawsuits filed by Netlist.

Netlist was founded in 2000 by CEO Hong Chun-ki from LG Semiconductor. The company filed a lawsuit with the US International Trade Commission (ITC) in 2016 and 2017 against SK Hynix for infringing on semiconductor technology patents.

Meanwhile, the stock price of Netlist plunged nearly 30% in a day after the results of the appeal came out.
