[Alpha Biz=(Chicago) Reporter Kim Jisun] The Fair Trade Commission won the lawsuit worth KRW 1 trillion for six years and two months between Qualcomm and the Fair Trade Commission.
The Supreme Court's third division (Supreme Court Justice Roh Jung-hee) on the 13th upheld the original ruling that ruled in favor of the FTC in a lawsuit filed by Qualcomm against the FTC's imposition of fines and corrective orders. The ruling confirmed Qualcomm's fine at 1.311 trillion won imposed by the FTC at the end of 2016. It is the largest fine ever imposed by the FTC on companies.
The FTC imposed a fine of 1.311 trillion won on Qualcomm in December 2016 and issued a correction order. The decision is based on the judgment that Qualcomm has made "patent overuse of power" by refusing to sign license contracts with rival chipset manufacturers and signing patent contracts with mobile phone makers such as Samsung Electronics on one-sided terms. A long legal battle began in February 2017 when Qualcomm filed an administrative suit against the FTC's disposition.
