Samsung BioLogics 'half victory' in a lawsuit against Lotte BioLogics

[Apha Biz=(Chicago) Reporter Paul Lee] Some of Samsung BioLogics' applications for an injunction against three employees who moved to Lotte BioLogics were accepted by the court.

It is a violation of trade secrets, but the court judges that changing jobs cannot be banned.

According to legal circles on the 11th, the Civil Affairs Agreement Department 60 (Presiding Judge Lim Hae-ji) at the Seoul Central District Court partially cited an injunction filed by Samsung BioLogics against Lotte BioLogics on the 6th.

The court reportedly partially accepted Samsung Bio's alleged infringement of trade secrets and rejected its application for a ban on transfer to Lotte Bio. Under the ruling, former Samsung BioLogics employees who moved to Lotte BioLogics will be able to attend the company normally, but the technology they brought from Samsung will not be available.

Samsung claims to have taken technology related to biopharmaceutical consignment production (CMO), but Lotte denies it. Samsung BioLogics has decided to appeal the court ruling.

Meanwhile, this is the second time Samsung BioLogics has accepted an injunction against Lotte BioLogics.
