Solus Advanced Materials Rebuts SK Nexilis’ Trade Secret Allegations in U.S. Patent Litigation

[Alpha Biz= Paul Lee] Seoul, September 1, 2025 — Solus Advanced Materials announced that it has filed a rebuttal with the U.S. District Court for the Eastern District of Texas, firmly denying allegations of trade secret misappropriation raised by SK Nexilis in an ongoing patent infringement case.



Last month, SK Nexilis submitted a second amended complaint, seeking to expand the scope of the litigation to include claims under the Defend Trade Secrets Act (DTSA) and the Texas Uniform Trade Secrets Act (TUTSA). The company alleged that Solus had unlawfully acquired and misused confidential know-how.



Solus rejected these claims, stating that the technologies in question had been developed and widely used in the industry well before SK Nexilis’ market entry. The company emphasized that its European subsidiary Circuit Foil Luxembourg (CFL) had independently developed the relevant copper foil technologies as early as the 1960s and secured patents in the 1990s. “The allegations are unfounded, and SK Nexilis’ claims are inconsistent with established industry history,” Solus said in its filing.



The Texas court has not yet ruled on whether to admit SK Nexilis’ amended complaint. However, in a recent decision on July 23, the court denied SK Nexilis’ motion to exclude CFL’s prior art products as evidence, allowing Solus to submit them as key proof in its patent invalidation argument. Solus stated that it intends to leverage these prior art references as strong evidence in its defense strategy.
