More Than Half of Administrative Lawsuits Against Financial Regulators Tied to Monetary Penalties

[Alpha Biz= Kim Minyoung] More than half of administrative lawsuits filed against South Korea’s financial authorities in recent years are related to monetary penalties, reflecting a rise in legal disputes as financial sanctions intensify.

According to data released on April 13 by the office of Rep. Lee Jeong-moon of the Democratic Party, 51 out of 100 administrative lawsuits filed between 2023 and 2025 against financial regulators involve fines or penalty surcharges.

Unlike sanctions such as business suspension or license revocation, monetary penalties do not directly halt operations. However, when the amounts are significant, they can have substantial impacts on corporate performance and individual finances.

The share of individuals filing such lawsuits has also increased, indicating greater financial pressure at the personal level. Of the plaintiffs in cases filed between 2023 and 2025, individuals accounted for 43.8%, followed by general corporations (including accounting firms) at 29.0%, and financial companies at 23.9%.

As regulators have stepped up monetary sanctions in the name of investor protection, the total amount of penalties has risen sharply. According to the Financial Supervisory Service, fines and penalty surcharges imposed on financial institutions surged from KRW 15.27 billion in 2022 to KRW 43.92 billion in 2024—nearly tripling in just two years.

The growing number of disputes is also increasing the burden on regulators. The Financial Services Commission saw its litigation-related budget more than double over the past three years, rising from KRW 424.81 million in 2023 to KRW 799.40 million in 2024 and KRW 899.71 million last year.
